These Terms & Conditions ("Terms") govern your access to and use of www.oshcat.com (the "Site") and any services provided by OSHCAT ("we," "us," or "our"). By using the Site, booking a service, or engaging us under a separate agreement, you agree to these Terms.

1. Services

OSHCAT provides Environmental, Health, and Safety (EHS) services, including but not limited to:

  • Safety training (OSHA, NFPA, and industry-specific instruction)

  • On-site services such as eyewash station inspection and safety audits

  • EHS consulting, industrial hygiene assessment, safety management system design, risk mitigation, process safety, and contractor management

Specific deliverables, scope, schedule, and fees for consulting engagements beyond standard bookings are governed by a separate written agreement between OSHCAT and the client.

2. Booking and payment

Online bookings are payable at the time of booking via the payment methods supported on our Site. Confirmed bookings are subject to our Refund Policy, available at /refund-policy.

For training programs, audits, or consulting engagements arranged outside the standard booking flow, payment terms are set by the applicable proposal or contract.

3. Your responsibilities

You agree to:

  • Provide accurate and complete information when booking or contacting us

  • Provide a safe working environment for any on-site visit, including any required PPE, site orientation, and access permissions

  • Disclose known hazards relevant to the work being performed

  • Use any training materials, reports, or recommendations only for the lawful purposes for which they were provided

4. Professional services disclaimer — please read carefully

OSHCAT provides advisory services. Our training, audits, assessments, recommendations, and reports are intended to support — not replace — your organization's own safety program, your responsibility to comply with applicable laws and regulations, and the judgment of your safety, operations, and legal teams.

You retain full responsibility for:

  • Workplace safety, hazard control, and incident prevention

  • Compliance with all federal, state, and local regulations (including but not limited to OSHA, EPA, DOT, NFPA, and FDA requirements)

  • Implementing, maintaining, and verifying any controls or programs we recommend

  • The conduct of your employees, contractors, and visitors

Our findings are point-in-time observations based on information available at the time of the engagement. Conditions, regulations, and best practices change. We make no representation that following our recommendations will prevent any specific incident, injury, illness, regulatory action, audit finding, or financial loss.

Nothing we provide constitutes legal, medical, engineering, or insurance advice.

5. Intellectual property

All materials we create — including training curricula, slides, handouts, audit reports, assessment templates, and similar deliverables — remain the intellectual property of OSHCAT unless a written agreement says otherwise. We grant you a limited, non-exclusive, non-transferable license to use these materials internally for the purpose for which they were delivered. You may not resell, redistribute, or repurpose them for use outside your organization without our written permission.

You retain ownership of your own information, data, and records that you provide to us.

6. Limitation of liability

To the maximum extent permitted by law:

OSHCAT's total liability arising out of or related to any service, deliverable, or use of this Site, regardless of the form of action, is limited to the amount you paid OSHCAT for the specific service giving rise to the claim during the twelve months preceding the claim.

These limitations apply whether the claim is based on contract, tort (including negligence), strict liability, statute, or any other legal theory.

7. Indemnification

You agree to indemnify and hold OSHCAT, its principals, employees, and contractors harmless from claims arising out of: (a) your misuse of any service, training, or deliverable; (b) your failure to implement or maintain controls or programs as recommended; (c) your violation of any law or regulation; or (d) your breach of these Terms.

You may not use the Site to: violate any law; infringe anyone's intellectual property; transmit harmful code; attempt to gain unauthorized access; or scrape or harvest content for commercial use without permission.
